Description of the process for derivation of the Reserve Bid

Procedure:

1.       When the FC Chief Executive has notified an FSD District Manager that he has approved an area for allocation of timber rights under a TUC, the FSD District Manager requests the RMSC Director to prepare a prospectus for that area.

2.       The RMSC Director assigns staff as appropriate to prepare a prospectus for each area requested.

3.       Each prospectus for a forest reserve area will contain the following information in a binder:

a)       a technical description (co-ordinates, survey points etc) of the area;

b)       a summary of the most recent inventory information in both hard copy and electronic format (MS Excel), showing stock and stand tables and yield for each species;

c)       a map of the area showing: (i) each stocking quality class, (ii) the proposed harvest schedule in 5-year coupes, (iii) existing roads and other infrastructure, and (iv) locations of communities;

d)       a description of any environmental or other restrictions;

e)       a list of the stools, local communities affected;

f)         the amount of a performance bond that the winning bidder must post and maintain for the first year of the contract;

g)       the pro forma Timber Utilisation Contract and Social Responsibility Agreement;

h)       the time and place for the bid opening; and

i)         any other information specific to the area which may affect exercise of the TUC

4.       Each prospectus for a non-forest reserve area will contain:

a)       a technical description (co-ordinates, survey points etc) of the area;

b)       a summary of the most recent inventory information showing the stand tables and yield for each species

c)       a map of the area showing: (i) existing roads and other infrastructure, and (ii) locations of communities;

d)       a description of any environmental or other restrictions;

e)       a list of the stools and local communities affected;

f)         the amount of a performance bond that the winning bidder must post and maintain for the duration of the contract;

g)       the pro forma Timber Utilisation Contract and Social Responsibility Agreement;

h)       the time and place for the bid opening; and

i)         any other information specific to the area which may affect exercise of the TUC.

5.       Each prospectus, whether for forest reserve or non-forest reserve area, must clearly display the following statement:

"The information contained in this prospectus is provided to assist prospective bidders prepare their bids for a Timber Utilisation Contract covering the area described.  While the Forestry Commission has made best efforts to provide accurate and up to date information, it assumes no legal responsibility for any inaccuracies or lack of information and in no event will the Forestry Commission be held liable for any lost revenue or profit, or for any special, indirect, consequential, incidental or punitive damages, however caused, arising out of or related to the use of this information"

6.       Prospectuses for each proposed TUC area will be prepared in sufficient quantities to meet demand. The District Manager or his delegated staff at each office will provide a prospectus to any person who wishes to purchase one upon payment of the correct fee and will issue an official receipt.

7.       The fee for the purchase of a prospectus will be the Cedi 100,000. The TREC Secretariat shall, when necessary, seek TREC approval to adjust annually this fee in order to maintain its value in real terms.

8.       Anyone who has purchased a prospectus and wishes to inspect the TUC area described may do so upon obtaining the necessary authorisation from the District Manager concerned.  The District Manager will provide such authorisation free of charge for each prospective bidder and his personnel.
